  • Starting collective action has always been the big stumbling block for the left-of-center in America. Europeans would riot for far less. We need more unions and unions willing to be political to help act as a nucleus for mass protests to say they can’t just do whatever they want. People should believe they have power other than just voting or signing a petition.

    The Supreme Court made bribery semi-legal, elevated allied presidents to kings, and dismantled the regulations that do most of the heavy lifting to keep our air and water clean. While I concur with many Democrats correct statements about how bad these rulings are, they should be leading people to the streets. Hell, the three dissenting judges should be going before the senate to explain how antithetical to American democracy the most recent ruling is. Stop pretending the system is working when it’s in freefall with no correction in sight.

    There are some legal experts (and personally safe liberals) that are really devoted to the idea that the system works. If there is a big change in the legal system that on its surface seems horribly harmful, we need to look on the bright side rather than question tearing the system apart, because their whole identity is built around it just being a benign system bending toward justice if you wait long enough and the worst thing that could happen would be people losing faith in the “rule of law” and disrupting the status quo.



  • Only if the prosecutors can successfully prove they weren’t official acts, which will be non-trivial since so many things (like talking to advisors) are themselves official acts. It’s really unclear how functionally pierceable that outer layer of presumed immunity is. The burden to bypass it is placed with the prosecutors, and any decision can be appealed back to the Supreme Court that wrote a whole nonsense provision to protect him even in this state trial.


  • It effectively guarantees an appeal though. “Evidence shown to the jury was inadmissible” isn’t something a few months of delay changes, so it feels like they should just do the sentencing and start the process. Even if the judge rules that those weren’t official acts, that ruling will be appealed and the good liberal judges in New York will feel obligated to play the Supreme Court’s game regardless of how made up their BS is. Which again puts consequences beyond the election.

    This is just braindead gaslighting. We all saw his performance. Dedicated Democratic cheerleaders like the Pod Save America guys think it’s the worst debate performance ever and needs to be carefully considered whether he can turn things around (and frankly, are leaning toward the “he can’t” side). Democratic leaders have been giving guarded answers about how they support Biden’s decision on whether to stay in, not that he should of course stay in. This isn’t remotely “media moguls” doing. The wagon circling is transparent and stupid and not working.
